LEGAL NOTICE AND GENERAL TERMS OF USE
1. WEBSITE INFORMATION
In compliance with the duty to inform set out in Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, we provide the following data about the website owner:
Marketing e Innovación Online SL (hereinafter, the "WEBSITE") with CIF: B42624429, registered office at Avenida País Valencia, 181, Benissa (Alicante), and registered in the Commercial Registry of Alicante, Volume 4190, Folio 179, Entry 1 with Sheet A-163786.
The WEBSITE provides services directly, particularly those related to its activity as a travel agency, such as activities, tours, boat rentals, and guided visits.
2. SCOPE OF APPLICATION
2.1. These general conditions govern the use of the website http://www.marinalia.es/ (hereinafter, the WEBSITE), where Marinalia makes available, markets, and intermediates for users (hereinafter, USERS) the online collective purchase of products, services, and combined trips or tourist services under special conditions.
2.2. Any USER accessing the WEBSITE and contracting offers published by Marinalia agrees to be bound by these general conditions.
2.3. Access to the WEBSITE, directly or through any domain name that redirects to this WEBSITE, grants the visitor the status of USER and implies acceptance of all the conditions described in this document.
2.4. The WEBSITE reserves the right to modify, at any time and without prior notice to USERS, the contractual offer as well as the list of offers and prices or any other aspect of this legal notice, including the contracting conditions, while respecting operations already carried out by the USER.
3. TERMS OF CONTRACTING LEISURE PLANS
3.1. The WEBSITE may publish leisure plans, activities, and tours in the Valencian Community with limited duration and a maximum number of services available and may terminate the offer upon expiration or depletion of available offers.
3.2. The WEBSITE acts as an intermediary in the sale and provision of leisure plans.
3.3. The WEBSITE handles the management, processing, resolution, and returns of any incidents raised by USERS.
3.4. Leisure plans contracted by USERS will be directed and coordinated by the PROVIDER, who may impose safety measures or controls required to participate in the activity.
3.5. The WEBSITE is not responsible for expectations or outcomes created by the PROVIDER, notwithstanding periodic checks to ensure the offer aligns with the actual service or product.
3.6. To place an order, the USER must register via the form provided by Marinalia, filling in contact information and accepting the privacy and contract policy in this document.
3.7. To acquire the offer, the USER agrees to provide accurate and current contact, payment, and billing information. The WEBSITE is not liable for issues resulting from incorrect or outdated data.
3.8. Upon completion of purchase, the WEBSITE will provide the USER with a confirmation number and, within 24 hours, send an email with proof of purchase and provider contact information. It is the USER's responsibility to contact the PROVIDER to arrange the date and time of the activity.
3.9. Service delivery to the USER is the sole responsibility of the PROVIDER. The PROVIDER assumes liability for any damages or harm caused to the USER, including acts of God or force majeure, and must maintain insurance to protect the WEBSITE from any liability.
3.10. If the offer cannot be fulfilled due to reasons beyond the WEBSITE's control, it will attempt to offer a similar deal. If not possible, the coupon will be refunded.
4. PRICE, PAYMENT METHOD, AND PAYMENT SECURITY
4.1. Prices shown on the WEBSITE include applicable taxes.
4.2. The USER can pay for the selected leisure offer using the payment methods provided by Marinalia.
4.3. By accepting this document, the USER agrees to receive electronic invoices for purchases made on http://www.marinalia.es. The invoice will be available in the "My Purchases" section of the USER's Marinalia account.
5. COMPLETION OF LEISURE PLANS
5.1. Once the plan is acquired, the USER must redeem it under the conditions described in the offer or coupon.
5.2. The USER agrees that, once the coupon’s validity period has expired, as indicated in the offer or coupon, they lose any rights of use or claims.
6. WITHDRAWAL AND RETURNS
6.1. The USER may exercise the right of withdrawal within 14 calendar days from the date of purchase, as long as the service has not been used.
6.2. The right of withdrawal does not apply to tickets for events, lotteries, or any leisure services with a specific date or execution period. If the leisure plan does not specify a date and the USER has not contacted the establishment to make a reservation, the right of withdrawal still applies. Once a cancellation is accepted by the establishment, the USER may exercise their withdrawal rights if still within the legal period.
6.3. For "Sport and Adventure" and "Boat Rental" tours, the following cancellation refund policy applies:
- Up to 15 days before departure: 90% refund
- Up to 10 days before departure: 85% refund
- Up to 3 days before departure: 75% refund
- Up to 48 hours before departure: 65% refund
- Up to 24 hours before departure: 40% refund
- Within 24 hours: No refund
No-shows are not entitled to a refund unless otherwise agreed.
If the company cancels the activity, the USER may reschedule or receive a refund.
No compensation is owed if cancellation is due to force majeure (e.g., weather). A voucher or refund will be offered.
6.4. To exercise the right of withdrawal, the USER must send a clear statement via email to compras[a]marinalia.es, including the email used for the purchase and the coupon code. Marinalia will respond within 72 hours with precise return instructions.
6.5. Marinalia will issue a full refund to the original payment method within 14 calendar days of being informed of the USER's decision to withdraw.
6.6. Product Returns: Any claim for non-delivery or error in the delivery must be notified within a maximum of 8 days from the date the material was shipped.
The Customer will not be entitled to request a return if the error/defect has not been reported by emailing Customer Service at compras[a]marinalia.es within 24 hours of receiving the order to inform us of the problem.
The Customer must inspect the Products as soon as possible after receiving them to verify their conformity with the type of Product ordered and the absence of apparent or hidden defects. In any case, after receiving the Products, the Customer will have a period of 24 hours to file a claim with Marinalia for any possible difference in the type of Products delivered compared to those ordered or for the existence of an apparent defect in the Products. If the Customer detects a possible internal or hidden defect in the Products, the Customer will have a period of 3 days after receipt to file a claim with Marinalia.
7. PROMOTIONAL CODE TERMS
7.1. Promotional codes can be used for discounts on services in the Marina region. Their use is limited to the promotion period and specific conditions.
8. GENERAL CONDITIONS
If you do not cancel within the stated period, you forfeit the right to use the leisure plan.
Coupons can only be used once and will be sent to the email address used to register.
All bookings are subject to the service provider’s availability.
Plans and coupons cannot be exchanged for cash.
